WITHDRAWAL FROM THE CONTRACT
If
A) you are a consumer
or
B) you are a natural person and the contract you concluded with us after December 31, 2020 is directly related to your business activity, but is not of a professional nature for you
- in principle, you are entitled to itthe right to withdraw from a distance contract.
You can withdraw from the contract by submitting to usdeclaration of withdrawal from the contract e.g. via e-mail sent to the following address: info@energyway.com.pl
Return the returned item to us immediately to the following address: ul. Kępska 8, 45-129 Opole, but no later than within 14 days from the date on which you withdrew from the contract.
You can withdraw from the contract within the time limit14 days.
The fourteen-day period for withdrawal from the contract begins:
- for a contract in which we deliver an item and are obliged to transfer its ownership -from the time you take possession of the item or a third party other than the carrier indicated by you, and in the case of a contract that covers many items that are delivered separately, in batches or in parts - fromyou take possession of the last item, lot or part or a third party other than the carrier indicated by you.
To meet the deadline, it is enough to send the declaration before its expiry.
We will refund the payments you have made, including the costs of delivering the items in accordance with the terms set out in the regulations, immediately, but no later than within 14 days from the date of receipt of your declaration of withdrawal from the contract.
We may withhold the refund of the payment received from you until we receive the item back or you provide proof of sending it back, depending on which event occurs first.
Remember that you are not entitled to withdraw from a distance contract, among others: in relation to the contract:
- in which the subject of the service isa non-prefabricated item, manufactured according to your specifications orto meet your individual needs;
- in which the subject of the service isa thing that deteriorates quickly or having a short shelf life;
- in which the subject of the service is an item delivered in a sealed package, whichonce the packaging has been opened, it cannot be returned for health protection or hygiene reasons, if the packaging was opened after delivery;
- in which the subject of services aresound or visual recordings or computer programs delivered in a sealed package, if the packaging has been opened after delivery.

COMPLAINTS
If you are a consumer, if the goods purchased from us turn out to be defective, you have the right to make a complaint based on the warranty. It is best to submit a complaint to the e-mail address: info@energyway.com.pl or by post to the following address: ul. Kępska 8, 45-129 Opole.
Defective goods should be sent to the following address:

Due to the defect, you can request:
- exchanging items for ones free from defects,
- removal of the defect,
or submit a statement about:
- price reduction,
- withdrawal from the contract - in the event of a significant defect.
We are liable to you for defects discovered within two years from the date of delivery of the item.
As a rule, you can file a complaintreport within one year of noticing the defect, but the time for filing a complaint cannot end before the seller's liability period expires.
Your complaint will be considered (response to it) within 14 days from the date of our receipt of your complaint.
